For Corporations, the State of Delaware requires that you file for a business state income tax extension form 1100 regardless of whether you owe additional state income taxes or expect a refund. If the form is completed accurately and on time, you will be granted an automatic 6 month tax extension from your original filing deadline.
For Partnerships and LLCs filing as partnerships, extension of time to file returns may be obtained by submitting a copy of the Federal Extension Application on or before the due date of the partnership return. A photocopy of the approved Federal extension MUST be attached to the final return when filed. The approved Federal extension will extend the due date of the Delaware return to the same date as your Federal extension due date.
Filing a Delaware tax extension will not provide you with additional time to pay any tax balance due, which must be paid by your original tax deadline or interest and other payment penalties may apply.
